TEXT MESSAGING TERMS & CONDITIONS

By "Opting In" to or using a “Text MessageService” (as defined below) from NAMI Jacksonville, you accept these Terms& Conditions. THIS AGREEMENT IS SUBJECT TO BINDING ARBITRATION AND A WAIVEROF CLASS ACTION RIGHTS AS DETAILED BELOW.

This agreement is between you and NAMI JacksonvilleFlorida, Inc. All references to "NAMI Jacksonville,""we," "our," or "us" refer to NAMIJacksonville Florida, Inc., 40 E. Adams St., Ste. LL05,Jacksonville, Florida, Inc.

DEFINITIONS

"Opting In," "Opt In," and"Opt-In" refer to requesting, joining, agreeing to, enrolling in,signing up for, acknowledging, responding to, or otherwise consenting toreceive one or more text messages.

"Text Message Service" includes any arrangement orsituation in which we send one or more messages addressed to your mobile phonenumber, including text messages (such as SMS, MMS, or successor protocols ortechnologies).

CONSENTING TO TEXT MESSAGING

By consenting to receive text messages from us, you agreedto these Terms & Conditions.

E-SIGN DISCLOSURE

By agreeing to receive text messages, you also consent tothe use of an electronic record to document your agreement. You may withdrawyour consent to the use of the electronic record by replying STOP.

TEXT MESSAGE SERVICE PRIVACY POLICY

We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but isn't limited to, sharing information with platform providers,phone companies, and other vendors who assist us in the delivery of mobilemessages. Mobile information will not be shared with third parties/affiliatesfor marketing/promotional purposes. All the above categories exclude textmessaging originator opt-in data and consent; this information will not beshared with any third parties. Nonetheless, we reserve the right always todisclose any information as necessary to satisfy any law, regulation orgovernmental request, to avoid liability, or to protect our rights or property.

This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn't intended to modify any other agreement that you haveentered into with us, which may govern the relationship between you and us inother contexts.

COSTS OF TEXT MESSAGES

We do not charge you for the messages you send and receive via this text message service. But message and data rates may apply, sodepending on your plan with your wireless or other applicable provider, you maybe charged by your carrier or other applicable provider.

FREQUENCY OF TEXT MESSAGES

This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send youan initial message providing details about the service. After that, the numberof text messages you receive will vary depending on how you use our servicesand whether you take steps to generate more text messages from us (such as bysending a HELP request or opt in to other typesof text messages from us).

OPTING OUT OF TEXT MESSAGES

If you no longer want to receive text messages, you mayreply to any text message with STOP,QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. As a person-to-personcommunication service, opt-out requests are specific to each conversationbetween you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message.

SEVERABILITY

If any provision of these Terms & Conditions is found tobe invalid or unenforceable, the remaining provisions shall remain in fullforce and effect.

ARBITRATION

Any dispute, claim, or disagreement that arises out of or relates to these Terms & Conditions will be resolved only by binding arbitration. The arbitration will be conducted in the State of Florida by a neutral arbitrator, and both parties agree to follow the arbitrator’s decision.The arbitrator’s decision will be final and legally binding. By agreeing to arbitration,both parties give up the right to file a lawsuit in court and the right to a jury trial. Florida law will govern this arbitration. Judgment on the arbitrator’s decision may be entered in any court that has jurisdiction.

CLASS ACTION WAIVER

You and we agree that any dispute related to these Terms & Conditions or the text messages you receive must be brought only on an individual basis. This means that no dispute may be brought as a class action,collective action, private attorney general action, or any other proceeding where someone acts on behalf of others. You and we agree that claims cannot be combined or consolidated with claims of other people, and an arbitrator orcourt may not hear claims as a class or representative action. This waiver applies whether a claim is brought in arbitration or in court, to the fullest extent allowed by Florida law.
